what is this font. I'm sure they had it made for them but i want to know where i can get it. The ny times is selfish as they don't tell me.

If this is indeed a custom typeface, like you questioned/assumed, there may not be any way of 'getting' it. (But, Slightly modifying 'Memphis' may get you close enough.)
